TERMS OF SERVICE
These Terms of Service apply to purchases made through the FutureKind Store. The store is operated by FutureKind Pty Ltd.
By using the store or placing an order, you agree to these terms, together with our Privacy Policy, Shipping Policy and Return and Refund Policy.
PRODUCTS
FutureKind merchandise is printed to order. We aim to present product descriptions, images, colours, sizing and prices accurately.
Colours may appear differently depending on the device or screen used. Garment measurements may also vary within normal manufacturing tolerances. These variations do not limit your rights where a product is faulty or materially different from its description.
Customers are responsible for reviewing the product description and Size and Fit Guide and selecting the appropriate style, colour and size before ordering.
ORDERS
Submitting an order is an offer to purchase the selected products. An order is accepted when payment is successfully processed and an order confirmation is issued.
We may decline or cancel an order where:
• payment is unsuccessful or suspected to be fraudulent;
• a product or component is unavailable;
• an obvious pricing or product-information error has occurred;
• the delivery address cannot be serviced; or
• accepting the order would breach applicable law.
If we cancel a paid order, we will refund the relevant amount to the original payment method.
PRICES AND PAYMENT
All prices are displayed in Australian dollars and include GST where applicable.
Available payment methods are displayed at checkout. Payment must be successfully authorised before an order is submitted for production.
Shipping charges and any applicable discounts are shown at checkout before payment is completed.
DISCOUNTS AND COMPLIMENTARY PRODUCTS
Discount codes and complimentary-product offers may be limited to particular customers, products, groups, quantities, dates or uses. They:
• must be used according to their stated conditions;
• cannot be redeemed for cash;
• cannot be transferred or resold unless FutureKind agrees;
• may not be combined with other offers unless permitted at checkout; and
• may be cancelled where they are misused, duplicated or obtained without authorisation.
Any refund relating to a discounted purchase will not exceed the amount actually paid.
SHIPPING AND DELIVERY
Production and delivery arrangements are described in our Shipping Policy. Delivery dates are estimates rather than guarantees.
Customers must provide accurate contact and delivery information. FutureKind is not responsible for avoidable delays caused by incorrect information supplied by the customer, subject to applicable law.
RETURNS, REFUNDS AND CONSUMER RIGHTS
Returns, cancellations and refunds are governed by our Return and Refund Policy.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.
INTELLECTUAL PROPERTY
The FutureKind name, logo, artwork, website content, product designs and other materials are owned by or licensed to FutureKind. They may not be copied, reproduced, adapted, distributed or used commercially without written permission.
ACCEPTABLE USE
You must not use the store:
• for unlawful or fraudulent purposes;
• to interfere with the operation or security of the website;
• to introduce malicious code;
• to misuse discount codes or customer accounts; or
• to infringe the rights of FutureKind or another person.
THIRD-PARTY SERVICES
The store uses third-party services including Shopify, payment providers, fulfilment partners and delivery carriers. Their services may be subject to their own terms and privacy practices.
PRIVACY
Personal information is handled in accordance with our Privacy Policy. Information required to process and deliver an order may be shared with payment, fulfilment and delivery providers.
LIABILITY
To the maximum extent permitted by law, FutureKind is not liable for indirect or consequential loss arising from use of the store or a product.
Nothing in this clause limits liability or remedies that cannot lawfully be limited, including rights under the Australian Consumer Law.
CHANGES TO THESE TERMS
We may update these terms from time to time. The terms applying to an order are those published when the order is placed, unless a change is required by law.
GOVERNING LAW
These terms are governed by the laws of Victoria, Australia. The parties submit to the courts having jurisdiction in Victoria, subject to any rights a consumer has under applicable law.
